More Sri Lankan Judges to FIJI’S Judiciary




Former Justice Ministry Secretary and Additional Solicitor General Suhada K. Gamalath and prominent lawyer De Almeida J. Guneratne have joined a long list of Sri Lankan judges in Fiji.

Fiji President Ratu Epeli Nailatikau  himself has has  personally welcomed the new additions to the judiciary at ceremony at Government House in Fiji  on Monday.

Among those present were two other Sri lnkans,Resident Court of Appeal Judge, Justice Suresh Chandra and the Chief Registrar of the High Court Yohan Liyanage.

Last year may six sri lankan,s were appointed as magistrates and  Puisne Judges.

The government of Fiji had to look at appointing is seeking foreign judges to replace judicial officers whose appointments were revoked after an suspension of the country’s constitution.

There has been reports of corruption in the Fijian  judiciary.

Chief Registrar of the High Court, Ganga Irani Arachchi, had leave the judiciary after allegations of inappropriate conduct was raised . some time ago.

Last year the US Department of State said that- Fiji has a tradition of a strong judiciary where contractual rights are generally upheld. However, post-coup, the independence of the judiciary has come into question, raising concerns about due process of law.’

Recruitment of Sri Lankan and other commonwealth country judges is seen as a attempt to restore independence within the Fijian judiciary within the country.

Fijian Chief Justice Anthony Gates interviewed candidates in Colombo and met with then e Sri Lankan Chief Justice Asoka de Silva and Attorney General Mohan Peiris to discuss the possibility of allowing Sri Lankan judges to serve two-year rotations in the High Court and magistrate courts of Fiji. The  common origins of the two countries’ legal system is one of the reasons for Fiji to look towards Mean while the talk in Colombo is that recruitment to judicial postings within close circuits.
